BUYER:

The BUYER is a natural or legal person who makes a purchase from the www.dermoderm.com website and whose identity is determined based on the information provided at the time of the order.

The BUYER's name, surname/title, address, phone number, and e-mail address consist of the information entered at the time of the order.

ARTICLE 2 – SUBJECT OF THE AGREEMENT

The subject of this agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the product whose specifications and sales price are specified below, ordered electronically by the BUYER through the www.dermoderm.com website belonging to the SELLER, in accordance with the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.

ARTICLE 3 – PRELIMINARY INFORMATION

The BUYER accepts that before accepting the agreement, they have been informed clearly and understandably about the following matters through the website and that they have approved this information electronically:

1. The identity and contact information of the Seller
2. The basic characteristics of the product subject to sale
3. The sales price of the products, including all taxes
4. Payment method and delivery terms
5. Shipping and other additional fees
6. Right of withdrawal, terms of use, and duration
7. Cases in which the right of withdrawal cannot be exercised
8. Consumer complaint and application methods

The Preliminary Information Form and invoice located on the website are integral parts of this agreement.

ARTICLE 4 – PRODUCT INFORMATION

The type, brand, model, quantity, sale price, payment method, delivery address, invoice information, and shipping fee of the product are as specified on the order summary page shown to the BUYER at the time the order is placed.

The SELLER reserves the right to suspend or cancel the order if it determines that the information provided by the BUYER is untrue.

ARTICLE 5 – AGREEMENT DATE AND DELIVERY

The agreement is deemed to have been concluded on the date the order is confirmed by the BUYER.

The product will be delivered to the shipping company within 1-7 business days at the latest, depending on the SELLER's stock status, following the completion of the payment process.

Delivery will be made to the address provided by the BUYER at the time of the order.

If the product is inspected and damage is detected during delivery, it is recommended to have the shipping courier issue a Damage Inspection Report.

ARTICLE 6 – FORCE MAJEURE

Natural disasters, war, strikes, transportation problems, shipping delays, or changes in legislation occurring beyond the control of the parties are considered force majeure.

In such cases, the parties cannot be held liable if they are unable to fulfill their obligations arising from the agreement.

If the force majeure event lasts for more than 30 days, each party has the right to terminate the agreement.

ARTICLE 7 – RIGHTS AND OBLIGATIONS OF THE SELLER

The SELLER agrees to fulfill its obligations regarding the delivery and sale of the product subject to the agreement in accordance with the legislation.

The SELLER will process the order placed by the BUYER after receiving payment confirmation.

If the product is not in stock, the SELLER may inform the BUYER and cancel the order, or send an equivalent product with the BUYER's approval.

ARTICLE 8 – RIGHTS AND OBLIGATIONS OF THE BUYER

The BUYER accepts that the information provided at the time of placing the order is accurate.

The BUYER is obliged to inspect the product before accepting delivery.

The product received is deemed to be intact.

The BUYER is liable for damages resulting from the unauthorized use of credit card information within the scope of the agreement between them and the relevant bank.

ARTICLE 9 – RIGHT OF WITHDRAWAL

The BUYER may exercise the right of withdrawal within 14 days from the date of receiving the product without stating any reason.

To exercise the right of withdrawal, the SELLER must be notified by e-mail or in writing.

In the event that the right of withdrawal is exercised:

• The product must be unused and in a condition suitable for resale
• The invoice and all accessories must be returned with the product
• The product price will be refunded to the BUYER within 14 days at the latest from the date the SELLER receives the withdrawal notice

ARTICLE 10 – CASES IN WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for the following products:

• Cosmetics and personal care products whose packaging has been opened
• Products that are unsuitable for return for health and hygiene reasons
• Products prepared according to the consumer's request
• Perishable products

ARTICLE 11 – CONFIDENTIALITY

The personal data of the BUYER is processed within the scope of the Law No. 6698 on the Protection of Personal Data.

ARTICLE 12 – EVIDENCE AGREEMENT

In the event of disputes between the parties, the SELLER's commercial records and electronic records shall be considered conclusive evidence.

ARTICLE 13 – COMPETENT AUTHORITY FOR DISPUTES

In disputes, Consumer Arbitration Committees are authorized within the monetary limits determined by the Ministry of Trade; in cases exceeding these limits, Consumer Courts are authorized.

ARTICLE 14 – EFFECTIVENESS

The BUYER accepts that they have read and understood all the articles of this agreement and have approved it electronically.

The agreement enters into force at the moment it is approved by the BUYER.
